Coastal Commission updated Land Use Plan issued 1.29.2010

Boaters for Dana Point Harbor received the following updated document issued by the California Coastal Commission Staff to the Applicant: the City of Dana Point and the County of Orange. The document is intended to embody the agreement reached during the hearing on October 8th 2009 in Oceanside. The City and County have been afforded the opportunity to review and wordsmith the document. The public will only have a similar opportunity to do this when the issue comes before the City for ratification and the Coastal Commission on appeal.

Coastal Commission Staff Report & Important Documents from October 2009 Hearing

Boaters for Dana Point Harbor want the revitalization to move forward in a way that preserves recreational boating in Dana Point Harbor. You can read the proposed changes to the Land Use Plan that we submitted to and reviewed with the Commission Staff: Proposed LUP Modifications. Thankfully many of these items were included in the updated Land Use Plan. You can now read the Staff Report, the Updated Land Use Plan and the Additional Exhibits along with the Original Exhibits. While the progress has been good we had lots to do and still have more that must be done. Please make sure you attend the hearing in Oceanside and participate to the best of your ability.

Coastal Commission Staff Report - Left over from June 2009 Hearing

The linked document was provided by the California Coastal Commission Staff. As the City/County failed to adhere to Chapter 3 the CCC Staff completely re-wrote the Land Use Plan, Exhibit #17. The staff report is very important but it is Exhibit #17 that will become the controlling document if this passes

Local Coastal Program Amendment 03-06 Commercial Core
The document that will be reviewed by the Californa Coastal Commission is called a Local Coastal Program Amendment, in our case LCPA 03-06.

Final Environmental Impact Report, FEIR
The FEIR was approved by the County Board of Supervisors on January 31, 2006. The LCPA 03-06 needs to be consistent with this FEIR or there must be additional California Environmental Quality Act supporting materials explaining any differences. The document can be found in several files at: www.danapointboaters.org/documents.htm.

Public Trust Documents
In 1961, the California Legislature granted a Tidelands Trust for the creation of our Harbor. These two documents, Public Trust Doctrine and Public Trust Policy, will help you understand the principles and procedures.

California Coastal Act of 1976
This act created the California Coastal Commission and set forth the legislature's intent for how Coastal Resources are to be managed. The current document can be found at: www.coastal.ca.gov/coastact.pdf. While there are many interesting areas, Chapter 3, Article 3 is of particular interest.

A Boaters Prescription for Dana Point Harbor
The original document was published by the Dana Point Boaters Association on 1.17.08. After the conclusion of the public comment period in September the document was updated in October and is currently awaiting approval by the Board of Directors. The Board has issued a one page overview. Once the full document is released it will be posted here.
